Some have argued that determinate sentencing is fairer and just and reduces prosecutorial bias. Which do you think provides a fairer/more just outcome for potential defendants: prosecutorial discretion and allowing them all of the "freedom" to make charging decisions, sentencing recommendations, power to dismiss, enter into pleas, etc.,? Judicial discretion, or determinate sentencing?
