Aramis Ayala approached her role when elected as State Attorney in Florida's 9th Judicial Circuit. Once in that position Ms. Ayala refused to seek the death sentence when prosecuting cases but, stated that she would changer her position on the matter if evidence was presented which indicated to her that the death penalty could be exacted in a swift, inexpensive manner, which was free of the risk of error. In taking this position, Ms. Ayala's put her at odds with law makers, including the governor, who claimed she was refusing to follow the established law. Examine the manner in which prosecutors such as Ms. Ayala have exercised their prosecutorial discretion to accomplish reform of the criminal justice system; and whether that is an appropriate thing for them to do.
