Samir previously fathered an illegitimate son with another woman in Pakistan before he met Yasmine. The son is named Mehran, and he is now six years old. Mehran is living in Karachi in his mother's custody. Mehran was fathered from a one-night-stand at a party when Samir was intoxicated. Samir pays child support but is not actively involved in his son's life.
The case is still under process at the overseas visa post. The visa officer has expressed additional doubt that Samir and Yasmine will settle in Canada because of Samir's son.
As counsel, how would you address this concern?
What type of evidence would Samir need to provide to show that his son living in Pakistan is not relevant to his intention of settling in Canada? You may fill in certain non-essential gaps with your imagination.
