The historical situation in which the excerpt was produced is the moment where different groups of Europeans started taking territories of Native Americans( that didn't belong to the Europeans) not giving the Native Americans any kind of benefit at the time.

One argument made in the excerpt is the statement made by Winthrop, "That which is common to all is proper to none," and also saying the Native Americans do not have any kind of little or property for the lands where they were in that moment, and Winthrop's opinion would allow the Europeans to take over this land without any kind of problem.
