A group of aged care workers are planning a social night out. Their manager is organising dinner at a local pub, and advises staff they are welcome to bring a friend or partner and to respond via email of their acceptance and if they will bring someone.
A new employee, Tom, is keen to attend - it's a great opportunity to social and get to know his new colleagues in a more relaxed environment. He decides he will bring his partner of 5 years, Dave.
Tom responds to the email invite his manager has sent out, saying in the body of the email that Dave will attend too.
The next day, the date of the dinner changes due to 'a number of staff being unable to attend' . Tom accepts the new date. Two days later it changes again. He is unable to attend this time, Dave has his own work function and Tom always attends them.
A couple of days later, Tom is in the lunch room telling a colleague about Dave's work function and how much of a good time they had. Two staff get up and leave the kitchen during this chat.
The colleague tells Tom it's fantastic that Dave's work is so accepting, and rolls their eyes in the direction of those who departed the room.
Tom discovers that some people in the department were uncomfortable with the idea of Dave going to the dinner, and that the manager kept changing the dates with the hope that Tom would be busy, and that the rest of the staff could still come.
a)Identify the type of legislation and types of workplace procedures that have been breached and how.
b) Explain how this situation can impact the cultural safety of the workplace.
c) Explain how this situation can impact Tom socially and professionally. Consider in your response the impact on his relationships with others in the workplace and his relationship with Dave.
d) Explain actions that Tom could take in this situation. Imagine that his workplace does not handle the situation and Tom continues to be excluded. What could he do next?
a. The Code of Conduct and Anti-discrimination and harassment policy has been breached in Tom's case.
Anti-discrimination and anti-harassment policy protects officers and staff from discrimination based on certain personal characteristics, such as race, ethnicity, sex, age, sexual orientation and gender identity. But in the case of tom, he is being purposely excluded in company gatherings because his co-employees are not comfortable with his partner Dave. Which is a clear evidence of discrimination in the workplace. Another violation is in Code of Conduct which consist of ethical principles in company includes workplace behavior and respect for all people. Here the manager's behavior towards Tom is disrespectful. The manager is biased; favoring the other employees request of excluding Tom because of his sexual orientation.
b. A culturally safe workplace has a defined set of values and principles, and demonstrates behaviors, attitudes, policies, and structures that enable all workers to work effectively cross-culturally. In a culturally safe workplace all workers feel comfortable, supported and respected. Here Tom is being discriminated and excluded which makes his workplace not culturally unsafe.
c. Tom will be deeply affected by this issue, having to face a difficult work environment he will be under a great deal of stress and have a hard time focusing on his job due to disagreements, disputes, or hostility from his manager and co-workers. His relationship with Dave will be affected too because his relationship with him is the reason behind his co-workers treatment towards him. On Dave's perspective there would be a possibility that he would blame himself which results to him to distance himself that may affect the stability of their relationship.
d Tom needs to file a complaint, contact his state, local or government employment rights office. Many state and local governments have their own anti-discrimination laws. These laws may offer extra protections beyond federal laws.
