Objective of this Assignment:

The purpose of this assignment is to apply your understanding of the youth justice process (your online Lesson 10) to an actual case in Canadian law.

COLLABORATION: A student may team up with 1 (one) other student to complete this assignment. If you collaborate with another student, only one submission is made, with both your names on the submission. Collaboration is entirely voluntary on your part; both students will receive the same mark for the assignment.

If collaborating on an assignment, you MUST include a one-(double-spaced) page Appendix to your paper which describes how you collaborated equally, and both reviewed and approved all sections of your paper.

A student is permitted to collaborate on only one assignment during this course. In other words, if you have collaborated on the Court Paper, you may not collaborate with a student on your Youth Justice Paper.

NOTE: If you have been granted the opportunity for an enhanced value on this assignment (i.e., worth more than 15%), you may NOT collaborate with another student on this assignment.

STEP 2:

 

ANSWER THE FOLLOWING QUESTIONS IN RELATION TO THE CASE YOU HAVE SELECTED:

 

1. Identify the case by the name of the offender and Criminal Code offence with which s/he was convicted. The offence must be accurately named and defined according to the Criminal Code; the CC section number of the offence must also be included.

 

If the offender has committed multiple offences, include the offence names and section numbers only, not the definitions.

 

2. Explain the current trend of this offence by youth in Canada. In other words, are youth offending rates increasing or decreasing for this crime? Your data must be within the last 10 years. If the data is unavailable for the specific offence, you may instead present the data for the category of offence to which it belongs (e.g., violent, property, other).

 

If the offender has committed multiple offences, include the data regarding one offence only, for which specific offence data is available.

 

Students MUST footnote any data presented in this paper.

 

 

3. Identify the sentence that was imposed on this offender at the conclusion of his/her trial.

 

 

4. Name at least 3 specific principles of Section 3 of the YCJA that are reflected in this sentence. These are the same principles presented at the beginning of your online Lesson 10. (Do not refer to the principles found in Section 38.) Explain fully how those principles apply to the sentence that was imposed.

 

 

5. Identify 2 other youth sentencing options appropriate to the case. Your answer must discuss separately two specific sanctions available to youth convicted of criminal offences, as outlined in your online Lesson 10. Identify why each of these sanctions could have been appropriate. For purposes of this discussion, assume a mandatory sentence does not apply.

1. Your assignment must be submitted as a FILE ATTACHMENT

2. Your name(s) must be at the top of the first page of your submission.

3. Do not submit your assignment as a .pdf or Zip file.

4. Your paper’s length must be 3 double-spaced pages minimum to 5 double-spaced pages maximum.

7. Your paper MUST be written in ESSAY format, i.e., in complete sentences and paragraphs, with:

- an introduction and conclusion

- sub-headings per section, e.g., “Current Trend for Offence X”, “Sentence Imposed", etc. Note that sub-headings for each section (sections 1-5 above) are MANDATORY

- complete references. Note that your textbook and Lesson materials for this course are not sufficient resources for this assignment.
