Professor Ana Fortaleza is a Brazilian historian who specializes in Latin American revolutions and revolutions generally in the Americas.  She has taught for many years at the University of Argentina in Buenes Aires. Her research has been well received in Argentina and other North and South American countries. She is the recipient of many highly regarded awards. Professor Fortaleza is well known in many nations outside her home country.

In the fall of 2019, Princeton University in New Jersey offered Professor Fortaleza a permanent position in its History Department. Princeton has arranged for her to enter the United States as a lawful permanent resident.  The job would commence in the fall of 2020. Although she was thrilled to be offered such a prestigious position with a well-regarded faculty, she hesitated to accept the position. She had recently married her long time fiance'. Her first husband had died in a tragic accident many years ago on an archeological trip up the Amazon River. Although she had two children at the time, she was very reluctant to remarry in the intervening years.

But time passes and the children grew older. Professor Fortaleza was now ready to marry a man she met several years ago whom her children love.  He too is a professor, John Reciffe.  Professor Fortaleza decided that she would accept the job offer at Princeton, but would marry Professor Reciffe in Brazil before they left for Princeton.  Her two children were very happy that their mother was finally remarrying.  The marriage occurred in Brazil in December, 2019.  In March, 2020, they arrived in Princeton.

Based on these facts, please answer the following questions:

(1)  When the married couple arrives in New Jersey, will their status as lawful permanent residents be on a "conditional basis" pursuant to Section 216 of the Immigration and Nationality Act of 1952?

(2)  If the couple decides to postpone their marriage until they fully resettle in New Jersey, will Professor Reciffe be able to enter the United States under Professor Fortaleza's visa although she has already moved to New Jersey while he remained in Brazil?
