Safety in the workplace it’s critical for everyone and should be one of the main concerns for employees and employers. It is essential for employees to understand the terminology and the appropriate channels available to request guidance so they can fully exercise their rights and responsibilities.    

What is the difference between guidelines and regulations?

Guidelines are documents in place to guide employees and employers through any given task by offering voluntary recommendations or best practices. Guidelines also provide certain degree of flexibility given any particular situation. Regulations are documented requirements that are, or enforce the law by prohibiting or allowing actions. When employees or employers fail to follow regulations, they are breaking the law and may incur in penalties. The main difference between them is that, guidelines are recommendations whereas regulations are requirements. The U.S. Food and Drug Administration (FDA) is responsible for protecting the public health by ensuring employers adhere to regulations. When companies fail to meet regulations, the FDA makes an observation and captures the deviation in FDA Form 483. FDA inspections to employers between October 1st, 2020 and September 30th, 2021 resulted in 2430 deviations (U.S. Food and Drug Administration).

Where would you look to find rules and regulations in order to meet compliance?

To exercise compliance and follow the law, I would reference The Code of Federal Regulations (CFR) annual edition. The CFR is the official legal print publication containing the codification of the general rules published in the Federal Register by the departments and agencies of the Federal Government (Code of Federal Regulation).

Provide an example of what is regulated in a lab environment and include the regulation regarding it.

Chemicals that are present in a lab environment or similar and may pose a hazard to health or immediate surroundings are regulated. These regulations are listed under 29 CFR 1910.1450, Occupational exposure to hazardous chemicals in laboratories.

Guidelines are suggestions for behavior, while regulations are the laws. While regulations are mandatory, guidelines are recommendations and not enforced. These regulations can be found in the Code of Federal Regulations (CFR), as published by the federal government. The lab I work in utilizes materials such as formaldehyde and xylene. Exposure is measured and monitored to meet the regulations of a title from the US Department of Labor, “1910.1450 - Occupational exposure to hazardous chemicals in laboratories”.
