Representative votes are carried out by secret ballot on the premises of the employer .The election is initiated and monitored by National Labor Relations Board(NLRB) and is expected to take place while there is a chance to vote for the highest number of workers. The phases of secret ballot representation electoral election are as follows,

Petition. The Union shall serve the employer petition along with a summary of the proceedings of the Board ,reminding the parties of their rights and duties in the process and a statement of position form.

Investigation. The regional Director of the Board shall review the petition and if sufficiently supported shall provide the parties with a notice of hearing for seven days from the date of service.

Identifying and narrowing issues. Here the employer provides a provisional list of voters and served by the employer listing their name ,job place, change and classification. The union refers to the position that the employer has taken. Both sides identify the facts applicable to any contested concerns that they may offer.

Hearing. The hearing officer of the Board recognizes differences and acknowledges facts only surrounding genuine material fact disputes.

Decision on pre-election issues. The employer shall give the final notice to the election workers at least two days before the election. and the regional Director shall where feasible distribute the final notice to the employees by email.

Election. A secret ballot election shall be held on the date specified in the direction of the election, the ballots counted ,and tally prepared. If the legitimacy of an electors is questioned, he or she is allowed to vote under questioning.

Decision on post election. Within seven days of the ballot count a group may send objections to the conduct of the election or conduct concerning the outcome of the election to the Regional Director, along with summary of the evidence supporting the objections.

Review of the Board. The parties will ask the Board at its discretion to review the pre or post election decisions of the regional Director.
