Explain the common law obligations every employee must adhere too after they have left their employment? These obligations do not need to be written into the employment contract. What about employees who are in a position of trust (fiduciaries)?
After leaving the employment, an employee is obliged to return any material company properties such as IDs, security cards, badges, company-borrowed computer, phone, car, keys, uniforms and other devices. Employees, once officially terminated from employment, must stop using or utilizing any company privileges and perks. It is also incumbent on the leaving employee to preserve any information that are considered sensitive to the employer or the company. Leaving employees still have to show some level of respect and professionalism.
For leaving employees who are in a position of trust, they are obliged to preserve all company and trade secrets as well as personal information of the employer. If the leaving employee had been handling monetary matters, he/she is required to remit any balance due to the employer. He/she shall likewise return any properties that give him/her access to the employer's bank accounts, checkbook and other related instruments. He/she must maintain the trust reposed to him/her and never use it for any unfair competition or other illegal activities.
