Douglas pushes Victor off the roof of a 20-story building intending to kill Victor. Meanwhile, Bradley, who also hates Victor, is in a room on the 7th floor of the same building. He had just finished cleaning and reloading his shotgun. He is sighting it out the window when he sees Victor falling and pulls the trigger. The bullet strikes Victor. The report of the medical examiner reveals that either the fall alone or the gunshot alone was sufficient to cause Victor’s death. Who is criminally liable for the death of Victor? Explain?
Barbara, a single mother of two children (one 8 years old, the other, 2.5 years old) decides to go out for the evening. The 8-year-old is given careful instructions on how to locate and call the mother, who is going to a place only 3 minutes away from the house. She will be gone for only 2 or 3 hours. The building burns, killing both children. How would you label the mother’s mental state? Was her conduct only ordinary negligence?
