Bobby Bigmouth is sued for slander by his boss. Bobby argues that he cannot be sued for slander because he did not publish any statement. He argues that his alleged slanderous comment was not published because he just made the comment to a co-worker about his boss rather than making that statement to a reporter to be published. Is Bobby's argument correct?
please explain in detail.
Answer:
According to me Bobby's argument is not correct because it may be true that he has not published the statement about his boss ,but he claims that he did make a slanderous comment about his boss to his co worker. As the boss of Bobby can blame him for self publication of the slanderous comment against the boss which could have damaged his image, and in regard to this his argument will be proven wrong.
If the employer acts with disregard for the statement ,and claims that Bobby's statement has harmed his image at a great extend and it is affecting his relations with the other companies and he is facing problem in developing relations with the other companies which is acting as a hindrance in growth of his business ,Bobby's boss can also be liable for defamation claim from him.
